Obtaining TN Status at Texas A&M University San Antonio

TN Status for Canadian and Mexican Professionals

The TN classification is a non-immigrant status specifically for Canadian and Mexican citizens under the provisions of the North American Free Trade Agreement (NAFTA). At Texas A&M-SA, the sponsoring department initiates this request through the Office of International Affairs.

1. Eligibility Requirements

To qualify for TN status, you must meet the following criteria:

  • Citizenship: Must be a citizen of Canada or Mexico.
  • Professional Level: The position must require at least a baccalaureate degree or specific professional credentials listed under NAFTA Appendix 1603.D.1.
  • Temporary Intent: You must demonstrate that your stay is temporary and that you do not intend to establish permanent residence.
    • Note: Because of the "temporary intent" requirement, TN status is not appropriate for faculty in tenure-track positions.
  • Employer Specific: You are authorized to work only for the petitioner (A&M-SA) and perform only the duties outlined in your offer letter.

3. Duration and Extensions

  • Initial Period: Granted for up to three years.
  • Extensions: Can be renewed in three-year increments.
  • Limit: While there is no regulatory limit on the total number of years, you must continually prove that your employment remains temporary and short-term.
  • Methods of Extension:
    1. Filing a petition with USCIS.
    2. Exiting and re-entering the U.S. (Mexican citizens must have a valid TN visa to re-enter).

4. Dependents (TD Status)

  • Spouses and children of TN holders are granted TD status.
  • Important Restriction: TD status holders are strictly prohibited from accepting employment or receiving any form of payment in the U.S.

5. Mandatory Check-In Procedures

Immediately upon entering the U.S. or starting your appointment at A&M-SA, you must:

  1. Contact International Affairs.
  2. Present original copies of your Form I-94 and your passport showing the TN admission stamp.
